Application for Full Membership: Monthly Term
1. Who owns and runs BodyWorksWest at Lambton Place?
BodyWorksWest at Lambton Place Health Club is the trading name of BodyWorksWest Limited (“the Club”). It is a private club owned by shareholders.
The Club is operated at all times through its directors and managers. Important communications can always be sent to: Alan Rivers 11 Lambton Place W11 2SH
2. An explanation of your Membership
We will decide whether or not to accept any application based on availability and other reasonable criteria.
The initial term you are applying for is one month. After this initial term, your membership will automatically continue in periods of a whole month until:
You cancel the arrangement, giving a month’s notice in writing or in person by the first day of the previous payment month; or
Your membership is terminated in accordance with 6 below.
We will only ask you to review and sign a new contract if the terms materially change. Otherwise the terms and conditions of this contract will apply for so long as you remain a member.
Membership of the Club is personal to you and cannot be transferred, assigned, sold or otherwise disposed of.

The Joining Fee and Subscription Fee quoted to you must be paid in full at the time of application.
Monthly payment may only be made by direct debit, and a mandate must be completed at the time of joining.
We have the right to vary the charge for your membership, and the payment to be collected, at any time, provided that we give you 14 days’ notice.
4. The Club’s obligation to you
We will provide you with the core facilities and services (“the Core Product”) for the duration of the term. This Core Product is defined below.
We will sometimes need to change what we offer, or vary (though only temporarily) the availability of the Core Product. If we do this we will, where reasonably possible, display notices in the Club or on our website notifying you at least two weeks before.
5. Your obligation to the Club
As a member you agree to comply with the rules of membership which are displayed prominently around the Club . We may make reasonable changes to these rules at any time, provided that we give you reasonable notice of the changes.
6. Termination of your Membership
We may terminate this agreement in the following circumstances:
If you commit a serious breach of this agreement or of the Club’s rules;
If you commit a less serious, but repeated, breach of the Club’s rules and you fail to remedy this breach within seven days of being given written notice of the Club’s concern;
If any part of your membership fee remains unpaid 14 days after its due date for payment; or
If you provide us with details which you know to be false, where these would have affected our decision to grant you membership.
If we do terminate the agreement, we reserve the right to retain a portion of the money that you have paid us to cover any reasonable costs we have incurred as a result.
You may terminate this agreement at any time by giving notice in writing or in person by the first day of the previous payment month e.g. by 1st August if you would like to cancel from the 1st September.
7. Refund policy
The Joining Fee is charged to reflect the additional services offered in the first month of membership, and to recoup our costs, including administration and marketing. Accordingly no refund of the Joining Fee will be available under any circumstances.
If you cancel your membership during the term you will not normally receive any refund. A refund might apply in the event of your death or serious injury or illness. In these circumstances, and where reasonable evidence has been presented, you may receive a part refund of the Subscription Fee reflecting the unused portion of the term, less any adjustment for the reasonable cost of administering the cancellation and refund.
8. Limitation of Liability
We will compensate you, or any of your guests, for loss or damage you may suffer if we fail to carry out our obligations under this agreement to a reasonable standard, or if we breach any duties imposed on us by law (including if we cause death or personal injury to you or your guests by our negligence), unless that failure is attributed to:
Your own fault;
A third party unconnected with our provision of services under this agreement;
Events which neither we nor our suppliers could have foreseen or prevented even if we had taken all reasonable care; or
Your failure to complete the mandatory series of Introduction to Exercise services we provide.
9. What and who is included in your membership?
The Core Product includes:
Reasonable access to the gymnasium, swimming, changing facilities and a range of classes, during the declared open hours relevant to those facilities, without any charge additional to the Subscription Fee; and
Reasonable access to treatments at the appropriate charge and during the declared open hours relevant to those services.
We will use our best endeavours to provide facilities and services additional to the Core Product, but we cannot guarantee their availability.
Children are not permitted at the Club.
You can Freeze your membership for a maximum of 2 months per membership year for a fee, subject to the rules of our Freeze Policy.
You can bring guests to the Club for a fee, subject to the rules of our Guest Policy.
Cancellation fees may apply if you book facilities or services and either cancel inappropriately or fail to turn up. Please consult the Cancellation Policy.
